1. DEFINITIONS

1.1 “Company” refers to GentleEvenings.fun, its owners, directors, employees, agents, and authorized representatives.
1.2 “Platform” refers to the website, WhatsApp booking channel, applications, and any digital interface operated by the Company.
1.3 “Client/User” refers to any individual accessing or booking services through the Platform.
1.4 “Companion” refers to a verified individual engaged by the Company to provide social companionship services.
1.5 “Services” refer strictly to lawful, non-physical, and social companionship engagements.

2. LEGAL NATURE OF SERVICES

2.1 GentleEvenings.fun operates exclusively as a social companionship platform.

2.2 The Services are limited to:

  • Conversation
  • Public outings
  • Event attendance
  • Social companionship
  • Emotional support interactions

2.3 The Company does not provide, promote, facilitate, arrange, endorse, or guarantee:

  • Sexual services
  • Escort services
  • Physical intimacy
  • Adult entertainment
  • Any activity prohibited under Indian law

2.4 The Platform shall not be interpreted as operating in violation of the Indian Penal Code, 1860, the Information Technology Act, 2000, or any other applicable legislation.

3. ELIGIBILITY

3.1 The User must be at least 18 years of age.

3.2 The User must provide accurate and verifiable identification details.

3.3 The Company reserves the right to suspend or terminate access without refund if:

  • False information is provided;
  • Identity cannot be verified;
  • The User violates these Terms.

4. BOOKING AND PAYMENT TERMS

4.1 All bookings must be made through the official Platform.

4.2 Full advance payment is mandatory for confirmation.

4.3 The Company shall not be liable for:

  • Payment gateway failures,
  • Banking errors,
  • Delays caused by third-party financial institutions.

4.4 Prices may vary based on duration, availability, or service type.

5. REFUND AND RESCHEDULING POLICY

5.1 No monetary refund shall be provided once a booking is confirmed.

5.2 Cancellation within 24 hours of booking shall not be eligible for refund.

5.3 The Client may reschedule within 15 days, subject to availability.

5.4 Any chargeback or unauthorized dispute may result in permanent suspension.

6. EXPENSES DURING MEETING

6.1 All expenses incurred during the engagement, including but not limited to:

  • Food and beverages,
  • Travel,
  • Tickets,
  • Entry passes,

shall be borne solely by the Client.

6.2 The Companion shall not be responsible for any such costs.

7. PERSONAL CONDUCT & PROHIBITED ACTIVITIES

7.1 The Client shall behave respectfully at all times.

7.2 The following are strictly prohibited:

  • Requesting sexual or intimate services;
  • Physical contact without consent;
  • Harassment or coercion;
  • Illegal proposals;
  • Recording without consent;
  • Contacting the Companion outside the Platform without authorization.

7.3 Any violation shall result in:

  • Immediate termination,
  • Forfeiture of fees,
  • Potential legal action.

8. STRICT PROHIBITION OF INTIMATE SERVICES

8.1 The Services are strictly non-physical.

8.2 Any form of physical intimacy or sexual conduct is expressly prohibited and outside the scope of Services.

8.3 No payment made to the Company shall be interpreted as consideration for intimate conduct.

8.4 The Company may report unlawful conduct to appropriate authorities under applicable Indian laws.

9. CONSENT AND RIGHT TO WITHDRAW

9.1 Both Client and Companion retain the absolute right to:

  • Refuse any request;
  • Decline participation;
  • Terminate the meeting immediately.

9.2 Withdrawal of consent must be respected without question.

9.3 Any coercion, inducement, threat, or manipulation constitutes a material breach of these Terms.

10. RELATIONSHIP BETWEEN PARTIES

10.1 Companions are engaged by the Company under contractual terms.

10.2 No partnership, agency, or employment relationship is created between Client and Companion.

11. PRIVACY AND CONFIDENTIALITY

11.1 The Company shall maintain reasonable confidentiality of user information.

11.2 Users shall not:

  • Share private details,
  • Post images or videos without consent,
  • Record interactions without authorization.

11.3 Violation may attract legal consequences under the Information Technology Act, 2000.

12. LIMITATION OF LIABILITY

12.1 The Company acts solely as an intermediary platform.

12.2 The Company does not supervise in-person meetings.

12.3 The Company shall not be liable for:

  • Personal disputes,
  • Emotional distress,
  • Misconduct,
  • Financial loss,
  • Actions taken independently by adults.

12.4 Use of the Platform is at the User’s sole risk.

13. INDEMNIFICATION

13.1 The User agrees to indemnify and hold harmless the Company from any claims, damages, liabilities, legal proceedings, or expenses arising from:

  • Misuse of the Platform;
  • Breach of these Terms;
  • Violation of law.

14. TERMINATION

14.1 The Company may suspend or terminate access without notice for breach of Terms.

14.2 Outstanding dues must be settled prior to termination.

15. FORCE MAJEURE

15.1 The Company shall not be liable for failure to perform due to:

  • Natural disasters,
  • Government restrictions,
  • Pandemic regulations,
  • Events beyond reasonable control.

16. MODIFICATION OF TERMS

16.1 The Company reserves the right to amend these Terms at any time.

16.2 Continued use constitutes acceptance of revised Terms.

17. GOVERNING LAW & JURISDICTION

17.1 These Terms shall be governed by the laws of India.

17.2 Any dispute shall be subject to the exclusive jurisdiction of competent courts in Madhya Pradesh, India.

18. SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the Company and the User and supersede any prior understanding.

20. Legal Clarification & Platform Nature Declaration

20.1 GentleEvenings.fun is a privately operated digital platform created and managed by its lawful owner.

20.2 The Platform is not an employment exchange, placement agency, brokering service, or rental arrangement of individuals.

20.3 The Company does not act as a pimp, procurer, agent, or intermediary for any unlawful activity as defined under the Immoral Traffic (Prevention) Act, 1956, the Indian Penal Code, or any other applicable legislation.

20.4 The Platform does not engage in trafficking, procurement, solicitation, or commercial exploitation of any person.

20.5 Companions associated with the Platform are engaged solely for lawful social companionship services under internal contractual arrangements and not for any prohibited activity.

20.6 The Platform is intended exclusively for lawful social interaction and personal entertainment in a non-commercial, non-exploitative, and legally compliant manner.

20.7 Nothing on this Platform shall be interpreted as offering employment opportunities to the public, rental of individuals, or brokerage of personal services.

20.8 Any misuse, misinterpretation, or unlawful representation of the Platform’s purpose by Users shall be solely their responsibility.

 

21. Declaration Regarding Nature of Service & Personal Conduct

21.1 GentleEvenings.fun provides strictly lawful, non-physical, and social companionship services.

21.2 The Service does not include, promote, facilitate, arrange, endorse, or guarantee any form of physical intimacy, intimate conduct, sexual activity, escorting, or adult entertainment.

21.3 No payment, booking fee, or service charge made to the Company shall be construed, interpreted, or implied as consideration for any physical, intimate, or sexual activity.

21.4 Voluntary Conduct & Personal Autonomy

In the event that any personal or private interaction occurs between two consenting adults beyond the expressly defined scope of the booked social companionship session:

(a) Such interaction must be entirely voluntary;
(b) It must be based on clear, informed, and mutual consent of both individuals;
(c) It must be free from force, pressure, coercion, inducement, misrepresentation, obligation, or threat of any kind.

21.5 Absolute Right to Refuse or Withdraw

Both the Client and the Companion retain the absolute and unconditional right to:

  • Refuse any request;

  • Decline participation in any activity;

  • Withdraw consent at any time, without explanation.

Withdrawal of consent must be respected immediately and without dispute.

Any attempt to pressure, manipulate, threaten, or induce unwanted conduct shall constitute a material breach of these Terms & Conditions and may result in immediate termination and potential legal action.

21.6 Exclusion from Scope of Service

Any interaction occurring independently by mutual and voluntary consent between adults shall:

  • Be treated as a purely personal and independent decision;

  • Remain strictly outside the scope of the companionship services offered by GentleEvenings.fun;

  • Not create any liability, responsibility, authorization, or endorsement by the Company.

The Company does not supervise, authorize, encourage, or assume responsibility for private conduct beyond the expressly defined social companionship services.

21.7 Legal Compliance

All users must comply with:

  • The laws of India,

  • Applicable state laws,

  • Public decency standards,

  • Relevant provisions of the Indian Penal Code and Information Technology Act.

Any unlawful solicitation, harassment, coercion, or misconduct is strictly prohibited and may be reported to competent authorities where required by law.
